- Purpose of collection: to provide products or services to fulfil our contract, to process your payment information, arrange for delivery, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud.

- Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number).

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the contact above to request deletion.

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, delivering and fulfilment of your order, and keeping you up to date on new products, services, and offers. We do not share, sell, rent or trade in personal information.

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information.

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. BY ACCESSING, USING, ORDERING, OR RECEIVING ANY OF THE SERVICES (INCLUDING, WITHOUT LIMITATION, ANY PREPARED MEALS OR ADD-ON PRODUCTS), OR BY CLICKING A BUTTON OR CHECKING A BOX INDICATING THAT YOU ACCEPT THESE TERMS, YOU ACCEPT AND AGREE TO BE BOUND AND COMPLY WITH THESE TERMS AND OUR PRIVACY POLICY INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS, USE, ORDER, OR RECEIVE ANY OF THE SERVICES .

If you are accessing, using, ordering, or receiving any of the services on behalf of an entity, then you represent and warrant that you: (i) are an authorised representative or agent of that entity with the authority to bind such entity to these terms; and (ii) agree to these terms on behalf of such entity. In such a circumstance, the words “you” and “your” as used in these terms will refer to and apply to both that entity and you personally.

You agree that you are the legal age of majority under applicable law to form a binding contract with LUVIN’BITES and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access, use, order, or receive any of the Services.

We reserve the right to amend these Terms and any document referred to herein, or any part thereof, at any time, by posting the amended version on this site. The most current version of these Terms will govern your use and access of the Services, including without limitation any content made available on or through the Services. These Terms may not be amended in any other way except through a written agreement by authorised representatives of each party.

The Services may be changed, withdrawn, or terminated at any time in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services is restricted to users or unavailable at any time or for any period.

During the ordering process, you will provide true, accurate, current and complete information about yourself as prompted by the order form. If you provide any information that is untrue, inaccurate, not current or incomplete, or if LUVIN’BITES has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, LUVIN’BITES has the right to refuse delivery of any and all current or future Services to you.

Your Credentials are specific to you and may not be shared with or transferred to any other person. You are solely responsible for maintaining the confidentiality of your Credentials and you will be held responsible for any harm caused by disclosing or resulting from any unauthorised use of your Credentials. You will not permit any other person to use your Credentials, and you will immediately notify Lovinlunch if you know or suspect that your Credentials have been used by any other person.

You may delete your Account by emailing us at info@luvinbites.ca with your deletion request and following the instructions we provide you. However, your Account deletion request will not be completed until all of your outstanding orders have been paid for or cancelled in accordance with these Terms.

Our Services.

School Hot Lunch Ordering. We make available various hot lunch meals for the delivery to addresses within our delivery areas, as specified on our website. The meal selection for each school day, and number of meals you receive each week for each of your children (your “Lunch Order”) as part of your order will depend on the selections you make on our website. Depending on the details of your Lunch Order and whether a promotional offer applies, the price of your order may change. You can find more information about our fees and the details of your Lunch Order by logging into your Account or by checking the email we will send to you. Unfortunately, hot lunches are not available everywhere, you can only order them if you live in one of our delivery areas and we have provided a link to your school’s specific ordering page. We set up a specific ordering system link to each school and it requires reaching a minimum order quantity before we can start accepting orders and servicing your school. Check out our website to confirm if you live within one of our delivery areas and contact us for information about minimum order quantity and setting up an ordering link for your school.

Insulated Bags and reusable containers. Lunch Orders may be delivered in a reusable insulated bags and/or reusable containers. After delivery of an insulated bag and/or reusable containers to you, you agree to cooperate with our reasonable requests to retrieve these insulated bags and/or reusable containers. Typically, this means that on the day of delivery of your Lunch Order, you will leave out for retrieval by us the previous Lunch Order's insulated bags and/or reusable containers at the drop-off point for your next Lunch Order. However, if you are not placing any future orders, we will require your reasonable cooperation with retrieval of any insulated bags and/or reusable containers. At all times, the insulated bags and/or reusable containers will remain the property of LUVIN'BITES. We reserve the right to charge you the cost of the insulated bags and/or reusable containers if we are unable to retrieve it after three attempts.

Items contained in Lunch Orders and add ons are not for resale or commercial use. The Services are for personal use only.

The hot lunches are meant to be eaten within 1 hour of delivery, or refrigerated and consumed within 1 day, if refrigerated. If the hot lunch meals were kept outside of fridge for more than 1 hour, you agree that you will not consume such meal nor will you permit any other person to consume such meal. Ensure you properly dispose of such Meal.

Delivery.

Drop Off. Products you order from us which we agree to supply will be delivered to the delivery address (the “Delivery Address”) recorded in your specific school's online order form either by us or one of our service providers (such as the person making the delivery, the “Courier”). Delivery is typically made by motor vehicle, trike and by foot, however if we use different means of transportation we will notify you in writing. We will leave the products at the designated drop-off area or with a designated authorised person collecting lunches for your school. Many schools have a designated drop-off area for lunches. In this case, you are responsible to instruct your children on how to collect their lunches. Each lunch is labeled with a child's name and grade/division/class designation as provided in your online Lunch Order. Each child is responsible for picking up only their own lunch and LUVIN’BITES is not responsible for any errors made during the pick up process, or any hot lunches missing as a result of a pick up error. Depending on the amount of orders in the school, we always strive to obtain school administration's or parent volunteer support, where available, with the lunch drop-off and pick-up process.

Freshness of Fonyo.

Our insulated bags are intended to keep deliveries of hot lunch melas warm during delivery.

You are responsible for ensuring that your kids hot lunches are consumed within 1 hour of arrival, or refrigerated.

SNOW DAYS and school closures. In the event of poor weather (such as snow) and/or unanticipated school closures, we will cancel this day's delivery and credit your account accordingly.

SICK DAYS. If your child(ren) are sick and not going to be in school that day, you are responsible to notify LUVIN’BITES by 9 am to cancell ordered hot lunch and get a credit into your account.

Responsibility. We try to make things easy for you, but without limiting anything else in these Terms, you acknowledge that you are responsible for, among other things:

ensuring that you and your kids are not allergic to any of the ingredients in your Hot Lunch Order or any other product we provide you.
ensuring that your Hot Lunch Order meets your child(ren)’s nutritional needs;
ensuring that the hot lunch meals are consumed within 1 hour of delivery and are not otherwise spoiled or compromised.

Risk and Title. Except with respect to insulated bags and reusable containers, transfer of title to any products we provide you, such as the meals contained in your Lunch Order, occurs when the product arrives at your delivery address and dropped off in the designated drop-off area or left with the designated pick-up person; provided that we have received full payment for such products. This means that once one of our products arrives at your address, you become the owner of it.

Products may differ slightly from how depicted in any illustrations, photography or descriptions on our website or in print.

Our products and services may change or be discontinued at any time. Products and services that are delivered will have similar characteristics of the products and services you ordered, but minor changes between what is delivered and what is described online are possible. LUVIN'BITES may deliver products or services with minor specifications changes, provided that there is materially the same characteristics of the ordered products or services.

When you provide a payment method, such as a credit card, that is accepted by us, you represent and warrant that you are authorised to use such payment method and that you authorise us or our third-party payment processor to charge your payment method for all applicable Charges. For example, when you make an order on our website, you permit us to charge the payment method you have chosen in the total amount of your order (including applicable taxes). If we, or our third-party payment processor, are unable to verify your payment method, or if it is otherwise invalid or not acceptable, we may suspend or cancel your order. Notwithstanding any suspension or cancellation of your order, you remain obligated to pay us for any Charges.

When incurring a Charge, you must provide accurate and complete personal and billing information as requested by us.

Except as otherwise provided in these Terms, or as is required by law, all purchases of Services are non-refundable and non-returnable. Subject to the terms applicable to your selected payment processing method, and applicable law, you are solely responsible for any unauthorised, fraudulent, or erroneous transactions related to your use of our website and/or your receipt of the Services.

Prices on our website are expressed in Canadian Dollars (CAD) unless otherwise noted. If the product or service sold has additional terms and conditions, those additional terms and conditions will be provided by us to you prior to the sale. Pricing and availability may change without notice.

At our discretion, we may make available certain Services and Products at a discount or for free for a trial period (“Promotions”). We reserve the right to modify or cancel these Promotions at any time.

Delivery of products is subject to availability. If you have paid for a product but it is unavailable, we will notify you of the unavailability and either refund you the purchase price for such product or provide you with a replacement product of equal or greater value.

You represent, agree and warrant to LUVIN’BITES that your Feedback does not violate the privacy rights, intellectual property rights, personality rights, or any other rights, of any person.

We do not represent, warrant or guarantee in any way our website’s continued availability at all times or uninterrupted use by you of our website. Although we work to provide you with accurate content, mistakes sometimes happen and we do not warrant that any content is or remains available, accurate, complete and up to date, free from errors or omissions or fit or suitable for any purpose. If we discover any material errors, we will email or phone you with a correction at the email address or phone number you have associated with your Account or online order form. You agree you are responsible for checking your email to confirm if any corrections have been sent to you.

YOU UNDERSTAND AND AGREE THAT YOUR ACCESS AND USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION OUR HOT LUNCH MEALS AND ADD ONS, IS AT YOUR OWN RISK. THE SERVICES AND OUR PRODUCTS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED CONDITIONS AND WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

NEITHER LUVIN’BITES NOR THE AFFILIATES NOR LUVIN’BITES’ OR THE AFFILIATES’ RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR SERVICE PROVIDERS MAKES ANY WARRANTY, REPRESENTATION OR ENDORSEMENT WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, CURRENCY OR AVAILABILITY OF THE SERVICES, INCLUDING WITHOUT LIMITATION ITS CONTENTS AND PRODUCTS. YOU DECLARE THAT YOU ARE AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH CONSUMING FOOD AND BEVERAGES, WHICH MAY INCLUDE, WITHOUT LIMITATION, ALLERGIC REACTIONS, DIGESTIVE REACTIONS AND CHOKING, AND THAT YOU FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF INJURY, DEATH, RESULTING THEREFROM.

WITHOUT LIMITING ANYTHING ELSE IN THESE TERMS, WE EXPRESSLY WARN YOU THAT SOME OF OUR PRODUCTS CONTAIN ALLERGENS AND THAT CROSS-CONTAMINATION OF ALLERGENS MAY OCCUR BETWEEN OUR PRODUCTS EVEN IF A GIVEN PRODUCT DOES NOT HAVE AN ALLERGEN ON ITS INGREDIENT LIST. YOU ASSUME ALL RISKS RELATED TO ALLERGENS AND RELEASE US OF THE SAME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LUVIN’BITES, ITS AFFILIATES, OR LUVIN’BITES’ OR THE AFFILIATES’ RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, SUBSIDIARIES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING ANY DAMAGES FOR BUSINESS INTERRUPTION, LOSS OF USE, LOSS OF DATA, LOSS OF REVENUE OR PROFIT, COST OF CAPITAL, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, PERSONAL INJURY, DEATH, PAIN AND SUFFERING, OR EMOTIONAL DISTRESS, WHETHER ARISING OUT OF BREACH OF CONTRACT, NEGLIGENCE, BREACH OF PRIVACY, OR ANY OTHER THEORY OF LIABILITY OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We may terminate these Terms without providing you notice.

You hereby agree to waive any right you may have to commence or participate in any class action against LUVIN’BITES or either of their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, subsidiaries, successors, and assigns related to any claim and, where applicable, you also agree to opt out of any class proceedings against LUVIN’BITES.

In no event will LUVIN’BITES be liable or responsible to you, or be deemed to have defaulted under or breached these Terms, for any failure or delay in fulfilling or performing any term of these Terms, when and to the extent that such failure or delay is caused by any circumstances beyond LUVIN’BITES’ reasonable control, including but not limited to flood, fire, earthquake, tsunami, extreme weather events, snow or ice storms, impassable terrain or roads, explosion, war, terrorism, invasion, riot or other civil unrest, embargoes or blockades in effect on or after the date of these Terms, national or regional emergency, strikes, labour stoppages or slowdowns or other industrial disturbances, passage of law or any action taken by a governmental or public authority, including imposing an export or import restriction, quota or other restriction or prohibition or any complete or partial government shutdown, or national or regional shortage of adequate power or telecommunications or transportation.

LUVIN’BITES may give notice to you by email, letter, or SMS to the applicable address or number you provide on your Account or online order form or by notice posted on our website. You may provide legal notices to us by letter at:
